IBMの訴状を読んで覚えておきたいと思った表現や気になった表現~段落6まで

IBMの訴状を読んで仕事で使えそうだから覚えておきたいなと思った表現や、事実として気になる部分や、おやっと思ったところ、などを少しずつメモ代わりに書いていきます。

日本語での訳出や和訳に慣れるために和訳にも試みますが、やっぱり和訳って難しいなと思いながら取り組んでいる次第です。おかしいと思われそうなところには自分で括弧書きで突っ込みを入れてありますが、何かコメントやご意見等がございましたらお知らせいただけますと幸いです。

COMPLAINT FOR PATENT INFRINGEMENT(最初の文)

Plaintiff International Business Machines Corporation (“IBM”) ... demands a trial by jury on all issues so triable ...

そのまま訳すと

「原告 International Business Machines Corporation(IBM)は、公判に付すことができる全ての争点について陪審員による裁判を要求する」

とのことです。

INTRODUCTION(段落1番~6番)

段落1番~6番はIBMという会社の概要や実績を説明している部分です。

段落2番で気になったところ

In fact, for each of the last 28 years, IBM scientists and researchers have been awarded more U.S. patents than those of any other company.

この文を意訳すると、過去28年もの間、IBMによる米国特許の年間取得数はどの会社よりも多い、ということが書いてあります。

実際に例えば2020年のデータは下のグラフの通りです。2位のサムスンもすごいなとは思いますが、IBMがダントツで多いですね。

段落3番

For example, for over twenty years, IBM has been a strong proponent of open source technologies. IBM was a founding member of Open Invention Network, the largest patent non-aggression community in history, which supports freedom of action in Linux, a key element of open source softwareIBM was able to leverage its patent portfolio to enable the broad industry adoption of open source technologies by pledging to provide open access to key innovations covered by hundreds of IBM software patents for those working on open source software.  And early in 2020, IBM joined the License on Transfer Network (“LOT Network”), a non-profit community of companies that supports open innovation and responsible stewardship of technology.  LOT Network affirms the traditional use of patents—safeguarding the innovations of companies who research, develop, and sell new technologies—while protecting its members against patent assertion entities who purchase or acquire patents from others.

この部分を和訳してみると

「例えば、IBMは20年以上にわたり、オープンソーステクノロジーを強く支持してきた。IBMは、オープンソースソフトウェアの重要な要素であるLinuxでの活動の自由を支持する、特許の攻撃的使用に対抗する(←意訳し過ぎor理解不足?)史上最大の団体であるOpen Invention Networkの創設メンバーであった(何故過去形?)。オープンソースソフトウェアに従事する人々がIBMの何百ものソフトウェア特許によって保護される重要イノベーションに自由にアクセスできるようにすることを約束する(pledgingの和訳はこれで良い?)ことにより、産業界がオープンソーステクノロジーを広く採用することができるようにIBMは自社の特許ポートフォリオを活用した(leverageはどう和訳すべき?)。IBMは2020年の初期に、開かれた技術革新と技術の受託責任を支持する企業の集まりである非営利団体、License on Transfer Network(LOT Network)に加入した。LOT Networkは、特許の昔ながらの利用を支持しており、新しい技術を研究、開発、および販売する企業によるイノベーションを保護すると共に、他社から特許を買い取る、または取得する特許主張主体(patent assertion entities)からメンバーを守っている。」

となります。括弧内の突っ込みが多くてすみません・・・。

ここでは、IBM特許権を振りかざして他社をいじめるような会社ではなく、オープンソーステクノロジーを支持してきた実績を持つことを強調しているものと思われます。 

 段落4番

As another example, IBM has pledged to let anyone working on solutions to the coronavirus pandemic use its patents for free.

 この文の和訳は

「他の例を挙げると、IBMは、コロナウィルスパンデミックの解決に従事している人にIBM特許を無料で使用することを約束している。」

となります。ここでもIBMがいかに気前よく社会に貢献しているかを強調しているように思われます。

段落5番

IBM also believes in the protection of its proprietary technologies, which result from IBM’s extensive investments in research and development and the hard work of IBM’s employees. IBM believes that companies who use IBM’s patented technology should agree to a license and pay a fair royalty.  When a company is using IBM’s patents without authorization, IBM first seeks to negotiate an agreement whereby IBM and the other company each receive a license to the other’s patent portfolio.  That way, each company can avoid litigation, be fairly compensated for the use of all of their patents, and maintain freedom to operate in their respective markets.  

ここは

「また、IBMは、研究および開発へのIBMの本格的投資やIBM社員の多大なる努力の結果であるIBMの専有技術の保護の正当性を信じている。IBMの特許技術を使用する企業はライセンスに同意して公正な使用料を支払うべきであるとIBMは信じている。ある会社がIBMの特許を許可を得ずに使用しているならば、IBMはまずは契約交渉を行おうとし、それにより、IBMとその会社が互いの特許ポートフォリオのライセンスをそれぞれ取得するようにしている。それにより、各会社は訴訟を避け、所有する全ての特許の使用に対して公正に補償され、それぞれの市場で営業する自由を維持することができる。」

と和訳しました。

ここでは、払うべき対価を払わずにIBMの大事な特許を勝手に利用している企業に対しては毅然として対応するが、いきなり訴訟を起こそうという気はなく、まずはライセンス交渉を提案して友好的に話を進めるのがIBMのやり方である、というようなことを強調しているものと考えます。

段落6番

In fact, long before Rakuten existed, IBM partnered with other companies to launch Prodigy, one of the very first e-commerce services.  Rakuten, which was founded in 1997, after ecommerce was already established, took those prior innovations made by IBM and others to create and run its new business.  As its business has developed, Rakuten has incorporated additional innovations pioneered by IBM.

ここの部分に対する私の和訳は

「実のところ、楽天が実在するよりずっと前にIBMは他社と提携して本当に最初の電子商取引サービスの1つであるProdigyを立ち上げた。電子商取引が既に確立された後である1997年に設立された楽天は、自社の新しい事業を創り営むために、IBMや他社によってなされたそれらの先行する革新を取り込んだ。楽天は自社の事業の発展に伴い、IBMが先駆けて開発したさらなる革新を取り入れてきた。」

です。ここは、覚えておきたい表現が色々入っているので訳出してみました。
